2020 State Employee Contract Ratification

Note:

Recently a postcard was sent to state employees regarding the ratification of our Union contract. The first sentence of the second paragraph on this postcard should have read: “However, the process is not complete. For the contract to take effect, you as a state employee must approve it.” 

State employees may have received correspondence from management regarding this. When AFSCME started contract negotiations in the Fall of 2019, the state was unwilling to agree to a raise for state employees. AFSCME did not accept this and the negotiations went to impasse. AFSCME members across Florida spent months fighting for this wage increase by holding rallies and lobbying the state legislature. That hard work paid off when a 3% raise was included in the proposed state budget that was signed by the Governor. Impasse rules as set by law (L 447.01 – 447.609) require that the next step is for employees to vote on it. Should they approve - all changes go into the contract and thus if the State does not follow through, employees have recourse. Should the employees not approve the contract, all improvements are erased and the contract reverts to the old language. The 3% was signed into law due to the hard work of our Union members. The accompanying contract language must be approved by members to cement the contract and the Union's ability to file a grievance should the state short change someone.

Contract Summary:

The following are highlights of the changes in the Contract that we urge you to approve:

Wages: Article 25: Section 3 – 3% increase to all eligible employees; a minimum annual increase of $1,000.00; Section 6 – all eligible Child Protective Investigators (Class Code 8371 and Senior Child Protective Investigators (Class Code 8373) shall receive a 10% increase; All eligible Child Protective Support Consultant (Class Code 8374) shall receive a 5% increase: Section 7 – all eligible Academic Teacher (Class Code 8093 and Special Education Teacher (Class Code 9095) shall receive a 15% increase 

Benefits: Article 27: No increase in premiums paid by employees

Meal: Article 18: Section 4 – Establishing Meal Period as a right; Section 6 – Payment to employee of Periods unused special compensatory leave credits when transferring to another agency

Discipline: Article 7 – Section 3 – Language addressing old disciplines to account for the nature of, seriousness of, and elapsed time between disciplines.

Grievance ProcedureArticle 6 – Section 3 – Streamlining procedure with language changes; 

Union Activities & Employee Representation: Article 5 – Section 6 – With 4 days’ notice, a Union Representative will be given space to meet with employees and a notice will be sent on the day of the visit to all employees; Section 8 – Contract Negotiations and Ratification procedures that include paid administrative leave for such activities

Dues: Article 3 – Dues Checkoff Rights Clause for Employees to remit dues via payroll deduction

Duration: Three Year Contract with re-openers for Fiscal Year 2021-2022 and 2022-2023 to discuss Wages, Benefits and 3 other Articles per party
